Technical definition
Terms of service, also published as terms and conditions or terms of use, typically cover permitted and prohibited use, account obligations, payment and refund terms, intellectual property ownership, limitation of liability, termination rights, and the governing jurisdiction.
They are distinct from a privacy policy, which concerns data handling and is required by privacy law. Terms of service are a contract the business chooses to set. Enforceability depends in part on how the agreement is presented, with an explicit acceptance step generally carrying more weight than a link in the footer.
In plain terms
The rules for using your thing, and what happens if someone breaks them.
Privacy policy is about their data. Terms of service is about your relationship with them.
Why it matters
For a business selling online or running an account-based product, terms of service are where the answers to expensive questions live. What the refund window is. Who owns what a customer uploads. What you may do about an abusive account. Without them, each of those is negotiated from scratch under pressure.
The two things worth getting right are specificity and consent. Generic terms copied from another company will describe a business that is not yours, and a refund clause that contradicts what your sales page promises is worse than silence. And if the terms matter, ask people to accept them at signup rather than relying on a footer link. As with any legal document, this page is background rather than advice.
